Five citizens from the Village of Essex Junction are appointed by the Board of Trustees to make up the Zoning Board of Adjustment. The main responsibility of the Zoning Board is to review conditional use applications to determine if they conform to certain elements of the Village Land Development Code and Comprehensive Plan. The Board is also responsible for considering, on an individual basis, whether variances to the zoning regulations should be allowed. The Board also hears appeals of the Zoning Administrator’s decisions.
In accordance with the Village of Essex Junction Charter: The Trustees shall appoint a Board of Adjustment to three year terms from among the qualified voters of the Village and shall provide standards and procedures for such board to hear and determine appeals from administrative decisions, petitions for conditional uses and variances as may be required by law.
Please be aware that Zoning Board of Adjustment members are not permitted to respond to emails that relate to an existing or proposed application that has or may come before the Zoning Board of Adjustment outside of a warned Zoning Board of Adjustment meeting or hearing. If you send an email to the Zoning Board of Adjustment, it is most likely you will receive a response from Community Development Dept. staff. This is because there are laws that prevent appointed officials from conducting business outside of a public meeting.
If you wish to discuss a concern with the Zoning Board of Adjustment, the best way to do this is to come to a Zoning Board of Adjustment meeting when an agenda item relates to your concern, or if your concern is not on the agenda, you can attend a Zoning Board of Adjustment meeting and address the Board at the beginning of the meeting in the Audience for Visitors portion where items not on the agenda can be discussed by the Board.
